New Fixed-fee Scale for Children Cases

Sweeping changes to the legal profession are being implemented by the government.

With effect from 1st April 2013, Legal Aid will be abolished for most types of children cases where parents have disputes with each other about contact, residence or other care issues to do with children. But Legal Aid is still available for care proceedings if social services are involved in taking a child into care.

This will mean that the vast majority of people will now no longer qualify for Legal Aid to resolve disputes about children.

We have therefore started to offer a low-cost fixed-fee scale of fees to cater for people who will no longer qualify for Legal Aid.

The Fixed-fee Scale

INITIAL FIXED-FEE ADVICE – £150 (£125 fee plus VAT). This includes initial advice, written confirmation, discussing the court process and mediation etc.

COURT PROCEEDINGS - STAGE 1 – Initiating Court Proceedings - £180 (£150 fee plus VAT excluding disbursement fees such as the £200 court fee for issuing an application). Our £180 fee includes completing the C100 court application form and sending this into Court.

STAGE 1A – Service of the papers upon the other side - £30 (£25 fee plus VAT) simply 1 letter to the other side and completing the Statement of Service and sending to court.

STAGE 2 – Representation at first Court Directions Hearing - £240 (£200 fee plus VAT). Representation normally will be at the Family Proceedings Court (FPC) but can be at the County Court where that matter is either adjourned or agreed straight away. Often, information from CAFCASS will be sought, or if violence is alleged the hearing will be adjourned for statements to be prepared/other evidence obtained.

STAGE 2A – £90 (£75 fee plus VAT). This includes meeting with you at our offices after a hearing, on conclusion of the matter or to update you on the progress of your case.

STAGE 3 – Representation following the first hearing and each additional review or directions hearings - £360 (£300 fee plus VAT) at the Family Proceedings Court or County Court.

STAGE 3A – Fees for preparation of documents will be split as follows:

1. "Scott Schedule" or a statement for an Applicant – £240 (£200 fee plus VAT)

2. "Scott Schedule" or a statement for a Respondent – £156 (£130 fee plus VAT)

3. Simple position statements – £180 (£150 fee plus VAT)

4. Lengthy statements in relation to disputed issues in readiness for a contested / final hearing will vary, but will start at £240 (£200 fee plus VAT). We will provide detailed quotes for any such work.

STAGE 4 – Preparation up to a final or contested hearing but not including representation at that hearing - £720 (£600 fee plus VAT – this is the maximum) – some clients might approach us only at this stage of proceedings so we will need to spend time getting up to speed with a case, however, if we have acted in the matter previously or the papers are small and the matter is simple we are likely to reduce this fee.

STAGE 5 – Fees for the Trial / Final Hearings / Contested Hearings will be dependent upon complexity. Sometimes you will have a trial to finally decide your case. Sometimes you may have a contested hearing mid-way through your case to decide some issues with the remaining issues decided at a final hearing. Most contested hearings or final hearings last no longer than a day. We will cap our fee at £960 assuming the hearing runs to no longer than a day (£800 fee plus VAT). If you want to be represented by a Barrister (Counsel) we can recommend Counsel and obtain a fixed-fee quote for you. We will charge a fee of £180 (£150 fee plus VAT) to brief Counsel to represent you at trial.
